Gay marriage cannot be legalized—Supreme

Amaravati: A five-member bench headed by Chief Justice DY Chandrachud clarified that it is not possible to legalize same-sex marriages and Parliament has the right to legislate on same-sex marriages. On Tuesday, besides CJI Chandrachud, Justice Sanjay Kishan Kaul, Justice S Ravindra Bhatt, Justice Hima Kohli and Justice PS Narasimha were members of the bench, except Justice Hima Kohli, the remaining four judges read the verdict. On this occasion, the court made important comments. It seeks to change the perception that homosexuality is only limited to the upper classes of the towns or the society. Opined that people should not be discriminated against on the basis of sexual orientation.

He said that the courts do not make laws, they interpret existing laws and implement them. He said that Parliament will decide whether a special marriage law is necessary or not. It has been suggested that the central and state governments should take steps not to discriminate against such bonds. CJI Justice Chandrachud said that children can be adopted by same-sex couples as well as unmarried couples. The Supreme Court opined that it is a misconception to think that only a married male-female couple can protect children.
